You represent that you are over the age of 18. The Company does not knowingly permit those under 18 to use the Service.

Third-Party Website Screenshots & the Inspiration Gallery
As part of the Service, the Company may feature screenshots, excerpts, or visual references of third-party websites and designs (“Third-Party Content”) for the purposes of commentary, critique, education, and design inspiration — for example, within an Inspiration Gallery.
With respect to Third-Party Content, the Company adheres to the following practices:
Credit and linkback: Wherever reasonably possible, the Company will credit the original site, brand, or designer and provide a direct outbound link to the original source.
No claim of ownership: The Company does not claim ownership of, or affiliation with, any Third-Party Content. All trademarks, designs, and copyrighted material remain the property of their respective owners.
Purpose and character of use: Third-Party Content is used in a limited, illustrative manner — to comment on, discuss, or showcase design trends and techniques — and is not intended to substitute for, compete with, or diminish the value of the original site or its owner's business.
Good-faith basis: The Company believes this use is consistent with fair use principles, but makes no legal representation or warranty that any specific use qualifies as fair use in every jurisdiction or circumstance.
Takedown requests: If You are the owner or authorized representative of a website or design featured as Third-Party Content and would like it removed, modified, or additionally credited, please contact the Company at kari@freshlylaunched.com with (a) identification of the content and its location on the Service, and (b) your relationship to the original site. The Company will review and respond to such requests promptly and, absent unusual circumstances, will remove or modify the content upon a good-faith request.

The Service may include general information, commentary, tips, templates, and educational content relating to design, branding, website strategy, and email marketing (“General Content”). General Content is provided for informational and educational purposes only and does not constitute professional, legal, financial, or business advice specific to Your circumstances.
Any services described on the Service (including, without limitation, Design Days, brand strategy engagements, website design, or email marketing services) are offered subject to a separate agreement, proposal, contract, or statement of work between You and the Company. Nothing on the Service constitutes an offer, guarantee, or warranty of specific results, and past results referenced on the Service (including client case studies or performance figures) are not a guarantee of similar results for You.
You are solely responsible for evaluating whether any General Content, strategy, or approach described on the Service is appropriate for Your specific business, legal, or financial situation, and We recommend consulting a qualified professional before relying on it.
Intellectual Property & Use of Our Content
Except for Third-Party Content (as described above), all content on the Service — including text, graphics, logos, designs, templates, photographs, and the overall look and feel of the Service (“Our Content”) — is the property of the Company or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Termination

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in any way related to the use of or inability to use the Service, even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.
Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. We also reserve the right, at Our sole discretion, to modify, expand, restructure, or discontinue the Service or any part of it — including its features, format, and offerings — at any time and without prior notice, except as required by law.
If a revision to these Terms is material, We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
